NearArc Consumer Health Data Privacy Notice
Effective date: 20 October 2026 · Last updated: 21 October 2026
This notice explains how NearArc collects, uses, shares and protects consumer health data. It applies to residents of Washington State under the My Health My Data Act, residents of Nevada under Nevada's consumer health data law, and anyone else covered by a similar law. It supplements the NearArc Privacy Policy, which covers all other personal information.
NearArc is a service provided by Zach Jensz (ABN 95 243 396 633), a sole trader based in Victoria, Australia (we, us, our).
Consumer health data means personal information that relates to your past, present or future physical or mental health, including disabilities and the accommodations you need. We collect it only for event accessibility and dietary needs, and we never sell it.
1. What we collect, where it comes from and why
| Consumer health data | Where it comes from | How we use it |
|---|---|---|
| Accessibility needs and disability-related accommodations for an event, such as wheelchair access, mobility support or sensory needs | You, or an event organiser who registers you or records your requirements | To arrange accessible venues, seating and support at events you attend |
| Dietary requirements that relate to health, such as food allergies, intolerances or medically required diets | You, or an event organiser | To arrange suitable catering at events you attend |
We may also analyse this information in aggregated or de-identified form, which no longer identifies anyone, to improve event planning and accessibility on NearArc.
We do not use consumer health data for advertising, recommendations, recruiting or any automated decision about you.
Health information you choose to share elsewhere. We don't ask for health information in your profile or messages. If you include it, we handle it as described in our Privacy Policy, including our moderation practices for messages. We don't use it for any other purpose.
2. Consent and sharing
We ask for your consent before we collect consumer health data, for example when you give us accessibility or dietary requirements for an event (there is not yet a field for this in the app, so today this would be by email). We share it only as needed to deliver the accommodations you request. You can withdraw consent at any time (see section 4). We never sell consumer health data.
| Who we share it with | What they receive | Why |
|---|---|---|
| Organisers of the event you're attending, including their organiser team | Your name and your accessibility or dietary requirements | To deliver your accommodations |
| Venues and caterers for that event, including sponsors who provide the venue or catering | Only the requirements needed, identified only where necessary | To prepare accessible spaces and suitable food |
| Our service providers, including hosting, database, email and content delivery providers | Data they store or process on our behalf | To operate NearArc, under contracts that limit their use of it |
We do not share consumer health data with recruiters or advertisers. A sponsor that provides the venue or catering receives it only in that role and only as needed to deliver your accommodations, not for marketing. Other sponsors receive only aggregated figures that don't identify anyone. We may also disclose it where the law requires.
On request, we will give you a list of the specific third parties and affiliates we have shared your consumer health data with, including their contact details.
3. Retention and security
We keep consumer health data only as long as needed to deliver the accommodations it was provided for, then delete it or de-identify it. If you withdraw consent or ask us to delete it, we delete it from our systems and tell the service providers and third parties we shared it with to delete it too. Copies in backups are overwritten on a rolling schedule. Organisers will be able to view attendee information but not export it (planned). If export is added and an organiser has exported attendee information to their own systems, they are responsible for deleting it there.
Access to consumer health data is limited to people and providers who need it. We protect it with the safeguards described in our Privacy Policy, including encryption in transit and access controls.
4. Your rights
You have the right to:
- confirm whether we collect, share or sell your consumer health data, and access it;
- receive a list of all third parties and affiliates we have shared it with or sold it to, with their contact details (we do not sell it);
- withdraw your consent to our collection and sharing of it; and
- have it deleted.
To make a request, email support@neararc.com from the address linked to your account, or tell us how to identify you if you don't have one. We will verify your identity, then respond within 45 days. If we need more time, we may extend this once by up to 45 more days and will tell you why before the first period ends. Requests are free, up to twice a year.
We will not treat you differently for exercising these rights. Withdrawing consent means we can't arrange the related accommodations for you.
Appeals. If we deny your request, reply to our decision with "Appeal" in the subject line. We will respond in writing within 45 days, explaining what we decided and why. If your appeal is denied, you can contact the Washington State Attorney General at atg.wa.gov, or the Nevada Attorney General at ag.nv.gov.
